Liability attorneys are some of the most maligned and misrepresented professionals in America. These specific types of attorneys are the first line of defense against rapacious corporations that do wrong in the pursuit of capital. What many people do not understand is that the insurance policies that are available to cover those who assure that business will not ride rough shod over us. What kind of lawyers professional liability insurance coverage is provided to protect them? No lawyer would represent themselves in court, and they also do not self-insure. If a lawyer is named in a suit related to work that he or she did, that lawyer then has to have insurance coverage to protect him or her against the possible consequences.

Malpractice, especially medical malpractice or negligence of a medical doctor, is a burgeoning segment of the legal community. On average, about six percent of all attorneys in the US will face allegations of professional misconduct or liability each year. Attorneys specializing in malpractice have a higher likelihood of facing this type of lawsuit than other professionals, by right of their chosen field. Lawyers professional liability insurance is the protective wall that attorneys rely upon to safeguard them and their practices. The details of this type of coverage are esoteric, at best, but better policies will cover a wide range of contingencies. Policies are often much customized to the pertinacious needs of the attorney and the type of practice involved.

The individuals that are covered by this type of liability insurance do not only include attorneys. Employees of the firm are also covered and, often, attorneys that sat in connection with a case performed at a previous firm will be covered as well. Generally, this type of coverage is best employed when the entire firm is protected. While a significant cost its well worth it. Covered incidence will be handled by the insurer allowing valuable, billable hours to continue while the case is handled. Of course, these along with a great range of other factors can be controlled by the firm in the options and contingencies that they seek coverage for.

If a covered situation arises, the insurer is expected to handle the initial phase of the claim as well as provide legal representation and expertise as needed to defend the client. However, fraudulent or criminal acts are not covered, only malpractice and similar claims, such as punitive damages. Additionally, any incident arising from services rendered to a business that is partly owned by the client firm or an attorney in the firm is not covered either. Ethics are a important consideration in the legal profession and lawyers professional liability insurance should be, and is held to a higher standard to fit the higher standards to which these professionals are held.
